Acceptable Usage Policy | Billing Policies

All Newroads Telecom Accounts are designed exclusively for responsible usage. The following is a list of unacceptable uses for using a Newroads Telecom service or system.
 
This list includes, but is not limited to:
All of the items listed in our Email AUP
  • Illegal Use: Using the service to transmit or receive material (by any means) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations.
  • Harassment: Using services or systems to transmit any material that harasses another.
  • Threats: Using services or systems to transmit material that threatens or encourages bodily harm or destruction of property.
  • Unauthorized Access: Using services or systems to access, attempting to access, or otherwise probe any computer hardware or software, electronic communications system, or telecommunications system that you do not have explicit authorization to do so. This includes any unauthorized access whether or not the intrusion results in the corruption or loss of data.
  • Copyright or trademark infringement. Using the services or system to transmit or receive any material that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal or receipt of copyrighted software.
  • Privacy of Others: Using services or systems to collect, or attempt to collect information about third parties without their knowledge or consent.
  • Denial of Service. Newroads account holders should not use their services for any activity that adversely affect the performance of other users of the Internet.
  • Excessive Use, Non-Interactive Use. All accounts and services are for individual, interactive use unless otherwise stated in writing. Users should not setup keep alive processes to maintain their connection.

This is a non-exclusive list and may be modified at anytime. Use of a Newroads Telecom access account or service confirms that you agree to these terms and all Newroads Telecom policies and procedures.

Newroads Email Acceptable Usage Policy

All Newroads Telecom email accounts are designed exclusively for individual interactive usage. The following is a list of unacceptable uses for using a Newroads Telecom email account or email systems.

This list includes, but is not limited to:
  • Sending Unsolicited Commercial Email or Unsolicited Bulk Email (SPAM). This includes any and all forms of bulk distributions.
  • Soliciting email addresses purchased or leased from a third party.
  • Subscription(s) to high volume email lists.
  • Subscribing to opt-in advertising lists.
  • Setting up high frequency automated processes to send or receive email.
  • Using a Newroads Email Account to collect replies to messages sent from another service provider which violates this policy or the policy of that provider.
  • Violating Newroads Policies from another service provider.
  • Forging email header information.
  • Distributing viruses.
  • Using a single email box for a multiple user account.

The following email types are strictly prohibited:

  • UCE, SPAM, Junk Mail
  • Chain Letters
  • Pyramid Schemes
  • Multi Level Marketing
  • MMF (Make Money Fast)

This is a non exclusive list and may be modified at anytime. Use of a Newroads Telecom Email account or Service confirms that you agree to this and all Newroads Telecom policies and procedures.

Starting March 18th 2002, all Newroads Dial-Up accounts will be subject to SMTP filtering. This will affect the ability of Dial-Up accounts to send email through a SMTP (outgoing email) server other than the one specified in the Newroads Dial-Up account settings.

Email was designed to be a efficient, cost effective interactive messaging system. However, there are some uses that are not within the design of email protocols. Using email outside of its design makes it hard for service providers to offer premium email service. Here are a few things that email is not suitable for.

  • Large or frequent file transfer
  • Instant Messaging
  • Broadcast Messaging
  • Secure Transmissions

BILLING POLICIES & PROCEDURES

  • Monthly Billing is based on the period of the 21st of month through the 20th of the following month.

Example: July 21st through August 20th is one (1) billing cycle.

  • Invoices are due by the 10th of the month.

Example: Service charges for July 21st through August 20th are due by August 10th.

  • First invoice will consist of the following charges:
    1. A pro-rated service fee determined by the actual date service was established through the date of the next billing cycle.
    2. Monthly service fee for the current billing cycle.
    3. Fees for Installation / Setup / Deposit, if applicable.**

Example: Of first billing statement for service

Service established on July 10th.

      1. Pro-rated charge for the period of July 10th through July 20th.
      2. Full-month service charge for July 21st through August 20th.
      3. Installation / Setup / Deposit fees, if applicable.**
      4. Total account balance will be due by August 10th.
  • IMPORTANT: All sign-up and/or setup fees are non-refundable!
  • A five (5) day grace period will be given for invoices not paid by the 10th due date.
  • Accounts reflecting a balance due after the 5-day grace period will be considered delinquent and are subject to suspension of service.
  • Accounts will be assessed a late fee if payment is not received by the 15th.
  • DSL/Telephone services suspended for non-payment will be charged a $31.75 re-connect fee per line. Dialup Internet services re-connect fee, $5.00 per connection. Chatterbox VoIP services suspended for non-payment will be charged a $15.00 re-connect fee.
  • Newroads Telecom has 24-hours from receipt of payment to re-connect suspended service.
  • The entire account balance (including late fees and reconnect fees) for the past due month must be paid-in-full before service will be restored.
  • Restoring service for non-payment suspensions will only be available during the normal Billing department office hours of Monday through Friday, 8AM to 5PM. **Customers will not be able to have service restored outside of these hours.**
  • Returned checks will be assessed the maximum fee allowable by law. This fee will be included in the total amount due and must be paid before service can be restored.

Payment Options and Policies

Newroads Telecom offers our customers several payment options:

MAIL-IN PAYMENTS/CREDIT CARD/DEBIT CARD/AUTO BANK DRAFT/MONEY GRAM

Choose one of the following Options:

1) Choose Auto-pay using either a credit card, debit card or a bank draft. Set this option up with a Newroads customer service representative.

2) Make a one-time payment for your service. Payment source can be credit card, debit card or bank draft. Contact a Newroads customer service representative for assistance making this payment.

3) Receive a monthly invoice and mail your payment to Newroads.

4) Utilize a Money Gram service to make your payment.

5) Use your credit or debit card online, to facilitate your payment.

  • If customer chooses to setup an autopay arrangement, monthly service fee(s) will be charged automatically to your credit/debit card on the 1st of each month OR, the first business day if the 1st of the month falls on Saturday/Sunday.
  •  VISA, MASTERCARD, DISCOVER and AMERICAN EXPRESS cards are accepted.
  • Bank draft returns will be assessed up to a $10.00 fee.

PAPER STATEMENTS

  • Invoices will be sent via U.S. Postal Service by the 25th of each month.
  • Dialup customers who choose a paper statement as their bill method, will be assessed a processing fee of $1.50.

E-MAIL / ONLINE BILLING

  • An e-mail message will be generated and e-mailed informing the customer of the availability of their Newroads Telecom invoice. This message will include a URL that is unique for each customer.
  • To access the designated URL, the customer will need to contact the billing department for login information.

CREDITS and REFUNDS

Very Important!

Please read your statement carefully. Billing errors should be reported immediately to our Billing Department at (479) 494-0300. Newroads Telecom assumes that charges are deemed correct if errors are not reported within 90-days of the date the statement was generated. NO refunds or credits will be issued for incorrect fees, which are not reported with in the 90-day window allowed.

  • Annual / Quarterly / Semi-Annual and promotion services are non-refundable.
  • Credits requested for early termination of services which are then cancelled any time during the service period will not be granted if the account has more than 1 hour of usage.
  • A referral credit cannot be refunded. In other words, a referral credit has no cash value. Referral credit can only be used towards payment of monthly service fees through Newroads Telecom. All credits are non-transferable.
  • In all cases, we reserve the right to turn any uncollected fees over to a collection agency.

Cancellation of Internet Service

Cancellation of Internet service must be received via US Postal Service, e-mail or verbal request by no later than the 19th of the month. This allows sufficient time to process the cancellation and remove the cancelled service from our billing records.

  • No credit adjustments or prorates will be given due to early termination of dialup Internet services.

Newroads requires the following information in order to cancel service:

  1. Name (or Contact person for company)
  2. Company Name, if applicable
  3. Address
  4. Phone number (daytime)
  5. Username / E-mail address of main account
  6. Type of service to be cancelled (dial-up Internet access, Fixed Wireless, Web Hosting, Local telephone service, Long Distance telephone service)
  7. Reason for cancellation*

* To help us better serve our customers, a representative may contact you to obtain feedback regarding your cancellation of service.

  • No adjustments/prorates on customers final Internet account bill.
